Terms
Identification: All purchasers are required to give full name, telephone number, email, full address, and credit card information.
Registration Authorization: Each auction you participate in Key City Auctions may temporally post a $1.00 charge to your credit card in USA funds to authorize your credit card. Within 48-72 hours the $1.00 charge will be released from your account. While the buyer’s credit card is initially charged in USA funds for the deposit only, buyer agrees and authorizes Key City Online Auctions Inc., to charge buyers credit card in USA funds for up to the full amount of the final payment if the payment terms and removal terms are not completed by the buyer.
Deposit: A Deposit may be required to register for and auction, if stated or may be required to continue bidding after a monetary threshold has been reached. Auctioneer, at their own discretion, may require a deposit from any bidder at any time. Failure to make a required deposit may result in suspension of bidding privileges.
Inspections:
It is the responsibility of the buyer to conduct their own inspection during the exhibition preview. No testing or operational assessments have been made by Key City Online Auctions Inc, including the condition of accessories or any other associated equipment, etc. If unable to be present for the preview you may contact the Key City Online Auctions representatives prior to bidding to answer any questions regarding any item. Video calls can be made for certain lots with prior notice. All known material facts conveyed to Key City Online Auctions have been disclosed. The buyer is accepting the property “as-is”.Risk to Person and Property: Persons attending the exhibition preview, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the Owner and Key City Online Auctions Inc. from liability therefore, neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises during the preview, sale, or removal.
Bid Verification: When placing a bid on an item, you will be asked to confirm your bid. This is to verify bidders are placing the correct amount. This is considered a legally binding contract.
Condition of Articles Sold: Neither the Owner nor Auctioneer shall be responsible for the correct description, genuineness, authenticity of, or defect in any lot, and makes no warranty in connection therewith. No sale shall be set aside, nor allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted. NO DEDUCTION ALLOWED ON DAMAGED ARTICLES. ALL ARTICLES WILL BE EXPOSED FOR PUBLIC EXHIBITION, AND SOLD “AS IS, WHERE IS WITH ALL FAULTS,” CONDITION. NO REFUNDS or CHARGEBACKS. ARTICLES ARE NOT WARRANTED AS MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE, AND NO CLAIM MAY BE MADE BY PURCHASER RELATING TO THE CONDITION OR USE OF ARTICLES PURCHASED, OR FOR PROXIMATE OR CONSEQUENTIAL DAMAGES ARISING THEREFROM.
Safety Devices: Articles purchased may not incorporate approved activating mechanisms, operating safety devices or safety guards, as required by OSHA or otherwise. It is purchaser’s responsibility that articles purchased be so equipped and safeguarded to meet OSHA and any other requirements before placing such articles into operation.
Manner of Payment: All security deposits shall be paid with credit card. Key City Auctions Inc. ONLY accepts the following forms of payment: Credit Card, Direct Deposit, Wire Transfer, and Zelle payments. Balances due shall be payable to the order of Key City Online Auctions Inc. The full purchase price on all lots sold to the same buyer must be paid within the time fixed and before removal of any of the goods.
Time of Payment: All invoices must be paid in full within 48 hours of completion of the auction.
Buyer's Premium: There will be a buyer's premium added to all winning bid prices, and the buyer's premium is subject to all applicable sales tax. See lot details for buyer's premium amount.
Taxes
All lots are subject to state and local sales tax. In order to claim tax exempt it is necessary that we have in our files a properly executed exemption certificate from all of our customers who claim sales tax exemption. Key City Online Auctions Inc. will NOT release items until we receive any necessary and properly executed tax exemption form. Contact Key City Online Auctions for the appropriate form. We need the sales tax form from the state in which the asset is sold, not from the state in which you are located. Guidelines and regulations regarding tax exemptions may vary between states. An invoice with payment instructions will be sent to each buyer’s registered email after the close of the auction. If you do not receive an invoice via your email or in your account within 24 hours after the close of the auction contact Key City Online Auctions.Removal:
Purchases can be Picked up/delivered/shipped only after invoice is paid. Person purchasing and whose name is on invoice must pick up. If sending a representative to pick up for you, you must provide them with a signed copy of the Bidder Agreement along with a copy of or with your valid ID or driver's license. This Form is located in the documents tab for this auction. Text 563-581-2297 or Email Admin@KeyCityAuction.com your name and the name of the person picking up on your behalf. All purchases must be removed as herein listed: Most items: Pick up within 2 days following the auction between 9AM-5PM. Removal shall be at the expense, risk and liability of the pickup person or purchaser. Key City Auctions Inc. ASSUMES NO RESPONSIBILITY FOR ITEMS LEFT ON PREMISES AFTER THAT TIME and WILL BE CONSIDERED ABANDONED WITHOUT PRIOR ARRANGEMENTS. Large Items: Can be removed at a later date by calling 563-581-2279 to arrange pickup appointment. Shipment of small Items: A representative will package each item or items and email a shipping and handling invoice. The emailed invoice must be paid prior to shipment. We ship via UPS Store or USPS from Dubuque IA. Key City Auctions will not be held responsible or liable for damaged or broken items during shipping. Large item shipments: Buyers can contract with UShip.com or other contract haulers of their choice. Local delivery: Delivery appointment requests can be made via email at Admin@KeyCityAuctions.com or by calling (563) 581-2279. Delivery fees start at $95 to the door and within the first 5 miles. Neither owner nor Auctioneer shall be responsible for the shipment of goods not removed within the time allowed. The buyer shall have the option to prearrange storage during the removal time as mentioned above. Items can be stored at the expense and risk to the purchaser for $10/Day Per LOT storage fee for a maximum of 30 days. The separate storage invoice must be paid prior to pick up. Any items NOT removed within 30 days' time and/or conditions aforesaid will be considered abandoned. The buyer loses all right to items and Key City Online Auctions has the right to dispose, resell, or return the items to the seller.
Buyers removing items on the premises must do so at their own expense and risk to their person and items. Key City Auctions requires proof of being listed as insured on current insurance policy for use of removal equipment at Key City Auctions Warehouse. The buyer will be held liable for any damage that is done to other items and/or property while on premises.
Contract Movers: If purchaser wishes to hire or contract with a machinery mover, rigger, auto hauler or other type of outside contractor, KEY CITY ONLINE AUCTIONS INC. WILL NOT BE HELD RESPONSIBLE or LIABLE for actions or damage caused to property by Contract movers.
Titles
There will be a $25 title processing fee applied to all items requiring a Department of Motor Vehicles tag if managed by Key City Auctions. Buyers will be contacted via email the day of the auction regarding titling information. Key City Auctions requires title information including name(s) and complete address via email. Title will be mailed to the buyer via certified mail no sooner than 14 days after receipt of payment. Buyers are responsible for investigating title and registration history prior to bidding on an item. Key City Auctions is not responsible for lost titles.Photos and videos: Please consider the photos and videos only part of the buying process and not the definitive authority. Photos and or videos may or may not depict all the positives or negatives of an item. These photos, videos, and descriptions are to be used as guideline only. All bidders are responsible for their own personal inspection of the item(s).
Odometer/Mileage/Hours: Odometer, Mileage & Hour Meter are assumed to be correct. However, these assumptions do not constitute a guarantee. It is up to the BUYER to validate the accuracy of the reading during the inspection process. Key City Auctions is not liable for any inaccuracies pertaining to the odometer, mileage or hour meter readings.
Sale by Estimated Weight, Count, or Measure: Where items are sold by estimated weight, count or measure, the purchaser will be billed for and required to pay for the estimated weight, count or measure. If upon delivery, any shortage exists; the purchaser will receive a refund at the rate of purchase. If there be an excess, the purchaser will be required to take and pay for such excess, at the rate of purchase.
Shill bidding: As a Key City Auction bidder, you agree to never bid on your own items and you will not bid on behalf of any other seller whatsoever. Any bidder participating in shill bidding will be banned from future auctions without notification and will be subject to legal action.
Reserve: Consignors have the ability to protect their merchandise with a minimum selling price. Reserve prices are designed to protect the owner of an auctioned item from an unfavorable outcome. Key City Online Auctions Inc. representatives will work with the seller to create a reasonable reserve, which must be agreed upon prior to the close of the auction. No reserves will be allowed after the item is sold.
Compliance with Terms of Sale: In default of payment of invoices in full within the time therein specified, the auctioneer and Key City Online Auctions Inc. reserves the right to all remedies allowed by law and may retain all monies received as deposit or otherwise, as damages. Thereafter the buyers Accounts will either be suspended or terminated.
Indemnification: Purchaser agrees to indemnify and hold Owner and Auctioneer harmless from and against all claims and liabilities relating to the condition or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state and local laws applicable to such articles, including OSHA requirements, or for proximate or consequential damages, costs or legal expenses arising there from.
Addition to or Withdrawal from Sale: The auctioneer reserves the right to withdraw from sale any of the property listed or to sell at this sale property not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all the property listed in bulk.
Dispute between Bidders: If any dispute arises between two or more bidders, the auctioneer may decide the same or put the lot up for sale again at once and resell to the highest bidder. The auctioneer’s decision shall be final and absolute.
Auctioneer rights: The auctioneer reserves the right to reject any bid which in his opinion is merely a nominal or fractional advance and might prove injurious to the sale. On lots upon which there is a reserve, the auctioneer shall have the right to bid on behalf of the seller to protect the property's value.
Additional Terms and Conditions: The auctioneer may add other terms and conditions of sale, such additional terms and conditions to be announced prior to the auction. ANY MALFUNCTION, Shutdown or Temporary loss of Service involving bidding for Items may render the results of the auction VOID. In such an event Key City Online Auction, Inc. reserves the right to remedy the situation in whatever way best represents the seller, including canceling the existing bids.
